I agree emphatically. There can be only one statutorily recognized
"official" record of a vote, and that everything else is "audit". The
significant problem that this presents is that there is (to the best of
my knowledge) no legislation or judicial precedent or ruling that
permits/allows/provides for the use of the "audit" to "represent" the
"official" record in situations that have/will occur when the "official"
ballot is either missing, tampered, or altered. A properly designed and
implemented system should theoretically be acceptable, however
ultimately this will become a matter for either the legislature or the
judiciary to decide and interpret.
